Overtime Payment : Worked on National Holiday / Declared Festival Holiday

santoshgupta@lntecc.com
As per the Law, if any workman works on any Festival / National Holiday then he will eligible to get the wages twice the rate of the wages or may be provided with a substitute holiday with pay.
My doubt is …….
If a workman works for 03 hours only on a national holiday then what amount he will get?
Per Day Rate is Rs. 400/-
Overtime Rate Is Rs. 400/- divide 08 Multiplied by 02 = 100/- Per Hour Rate (Double).
OT 03 Hrs X 100 = 300/-
Or
Rs. 400/- X 02 (Twice) = 800/-
Can anyone suggest …..

Dear Santhosh,
I think that it is not " twice the rate of ordinary wages " but only "double wages*.Please verify the relevant provision of your State NFH Act or State S&E Act.
Therefore, with the particular holiday's normal wages, he would get an extra wages of Rs.150/=only for the 3 hours worked i.e., 400/8X3.
The amount of extra wages depends on the method of calculation provided in the relevant Act is whether " twice the rate" or "double wages".
