Retrenchment Benefits: Should Gratuity Be Included After Five Years of Service?

If a worker is retrenched, he should receive the following benefits:

1. One month's notice or one month's salary.
2. 15 days' salary for every completed year of service.
3. Balance of bonus and leave salary.

Should he also be paid gratuity if he has completed five years of service?

1. One-month notice pay and in some cases 3-month notice pay, as the case may be.

2. This amount is equal to 15 days' average pay for each completed year of continuous service or any part thereof in excess of 6 months.

3. Balance bonus.

4. Payment for earned leave accumulated until the last working day.

5. Gratuity, if the employee has completed 5 years of continuous service, or any other pending payments with the establishment.
