Stuck in a Dual Employment Dilemma: How Can I Get My Relieving Letter Updated?

Hi team, I was working with an international BPO and quit the job to join a reputed bank in August 2014. My last working day was supposed to be July 31, 2014. However, since most BPOs have Saturdays and Sundays as fixed off days, my previous boss updated the last working day to August 3, leading to a situation of dual employment. Consequently, my new organization, the bank, decided to change my joining date to August 4 and provided me with a physical letter reflecting this change in November 2014.

When I inquired with HR about how long it would take for the update to reflect in the system, they mentioned it could take 2-3 months for all systems to be updated. Unfortunately, I missed checking on this. I have now left the bank and decided to join another organization. However, when I received the relieving letter from the bank, it did not include the modified date of joining. They are now refusing to update the letter, citing that it has been reported to statutory and compliance authorities as a 6-year-old issue.

When I questioned why the letter was originally issued without the correct date, they asked why I hadn't raised this concern in the past 6 years as the date of joining was mentioned in the letter. While I acknowledge the oversight on my part, the organization is avoiding updating the letter on statutory and compliance grounds, which has resulted in a dual employment situation and is preventing my new organization from hiring me. I have shared the letter with the new organization, and they are requesting a fresh relieving letter with the correct date only.

Please advise on how this issue can be resolved.

Will they issue a proper letter explaining the facts? If so, check whether such a letter will satisfy the new employer.

If they have paid you from 1st August, it will now not be possible to get a fresh order indicating a new Date of Joining (DOJ) as 4th August. Did you try with the erstwhile organization to show that they relieved you effective 31st July?
