You might have issued an appointment letter to this employee. Pls. refer term of appointment letter which normally have a term that you will retire from the services of the company on attaining age of 58 years. Referring that particular term/clause of appointment letter, you may retire him/her.

Pl check your coverage under the Industrial Employment (Standing Orders) Act 1947 or else the Shop & Establishment Act applicable to you. Is there a service condition or any precedent regarding retirement, then follow that.

Hi
The seems not complete/clear.
One can continue to be a member of PF even after 60 years if he is in employment.
Contribution to pension stops when you attain/complete 58 years of age.
As per company policy you can retire him or extend the service. No legal issue in this.
