what if the previous employer gives wrong information on background verification ? can it be challenged ?

Dear Sir ,
If the employer has terminated the employee on wrong illegal grounds & based on unilateral one-sided decision , then obviously they will give the wrong information on background verification to new employer .
please suggest how to come out of this situation so ,that new job can be saved and what are the remedies available .

If previous employer gives wrong information about you,it can be legally challenged.
You will have to prove illegal termination, one sided decision etc.

Short Answer- Yes

Long Answer-

Any good company while doing a BGV of an employee takes into account the feedback in totality.

They don't usually base their decision on 1 or sometimes 2 red flags.

A comprehensive background Verification BGV will include Employment/ID/Criminal and Income checks .

If one of them comes out with a red Flag,The company will ask you for an explanation.

You can then come out with a detailed explanation on why you think the feedback came in negative,Attach any proof like emails or documents which support your case and if the explanation is good enough they will consider you.

So long answer- Legal recourse are long,lengthy and expensive should be avoided as far as possible.Try to resolve it with your current HR
