A UK-based company, which has 10 years of working background in Mumbai, suddenly shut down its Mumbai branch during this lockdown, citing low business, without paying the salaries and other statutory benefits to the employees.

What action can be taken by the employees in this scenario?

Better make a written complaint to the State Labor Commissioner.

If the situation is because of Corona, they should have at least paid the salary if not benefits. As per the previous post mentioned, I would also suggest the same. Not paying even salaries is not correct.

To address the issue, an employee above workman status can lodge a complaint with the labor office and also file a civil petition.

Legal considerations for business shutdown during lockdown

First of all, to check the status and previous history of this business according to State Labour Laws and the Company Act of 1956. Legally, it is not possible to shut down a business during a lockdown period without paying statutory benefits. According to the Industrial Dispute Act of 1947, the provisions relating to the shutdown or closure of a business are clearly mentioned. Without following any labour law provisions, it is not possible to make such a decision. As mentioned in the previous post, I would like to suggest making a written complaint to the State Labour Commissioner.
