Unpaid Salary Since February 2020: What Documents Do I Need for Labor Court Action?

Hi all,

My organization has not paid my salary since 1st February 2020, which amounts to 2 months' salary. What documents should I possess to approach the labor court?

My overtime amount for 88 hours has not been paid by Quess Corporation at Flipkart BTS Malur.

Approaching the Prescribed Authority for Unpaid Wages

In my opinion, you should approach the Prescribed Authority under the Payment of Wages Act, 1936, which is generally the Assistant/Deputy Labour Commissioner of the area. There is a provision of up to 10 times compensation under the Act of 1936. However, if you approach the Labour Court under Section 33C(2) of the Industrial Disputes Act, there is no provision for compensation.
