Navigating Job Start Delays Due to Lockdown: Am I Entitled to a Salary?

SarathKrishna
Please help. Currently, I am working as an HR executive and am serving my notice period. My last working day will be on March 30, 2020. The date of joining for the new company is April 1, 2020, as per the offer letter. I received a call from the new company regarding extending my date of joining. My previous company has already processed my full and final settlement.

What should I do in this situation?

Am I eligible for a salary for these lockdown days from the new company? Please provide me with a legal opinion.

Regards,

Claiming Salary from a Prospective Employer Before Joining

How can a prospective appointee claim a salary from the prospective employer before joining the services? The lockdown due to the Corona outbreak is a national disaster beyond everyone's control; therefore, one cannot find fault with the prospective employer for extending your joining time. Thus, the period between your formal relief from the current job consequent on your resignation and your actual joining in the new job for which you stand appointed is just a phase of unemployment in your career. The consequential pecuniary loss, if any, caused to you in this regard is to be borne by yourself only. Alternatively, you can contact the new employer and explore the possibility, if any, of joining and working from home during the lockdown, the extension of which is likely.
