Seeking Advice: How to Handle Unpaid Salary and Prove Mental Harassment with Emails?

infoseeker
I used to work in a software company as a software architect. I was associated with them for six months. Due to ill health, I resigned and requested an early exit, to which the HR head agreed. I was told that I would receive my salary, which they had withheld earlier due to my sick leaves. All this was discussed in the presence of my manager, the HR head, and the HRBP.

However, after the resignation, I faced a lot of mental harassment as the company delayed issuing my relieving letter and accepting my resignation letter. To date, my settlement hasn't been paid. It's been more than 2 years now, despite my numerous follow-ups via email and calls.

Legal recourse and compensation

What recourse, legal or otherwise, can I take? The dues amounted to around 2 lakhs. Is it advisable to take legal action for such a sum? Can the mental harassment be proven by the emails I exchanged? And can I get compensation for the same?

Any help or guidance would be much appreciated.

Send them a legal notice asking for your dues. Have you received an accepted resignation letter and company clearance upon final exit? Getting your full amount should be enough, and unless you go to court, the company is unlikely to pay any compensation for harassment. Proving harassment is not easy in court - it is time-consuming and costly. Do not allow them to withhold your salary and final dues. Take action assertively yet politely for immediate payment by issuing a notice as suggested above.
