Maternity Benefit Dilemma: How to Claim Your Remaining 1.5 Months After Resignation?

My company has paid me 4.5 months of maternity benefits and has withheld the remaining 1.5 months' payment. I have already resigned from my post, but the outstanding payment has not been disbursed. What actions can I take under the Maternity Benefit Act?

Normally, a company should not withhold maternity payment. However, there could be other factors involved. For example, have you completed your exit formalities? Is your resignation accepted by your company? Did you resign in the middle of your maternity leave or after its completion?

I would suggest checking the company policies to see if there is any clause mandating the completion of the notice period. Many companies process Full and Final settlements after 45 days of the last working day. Please consult your company's HR department to seek clarification on this matter.
