Land Acquisition and Employment Obligations

Normally, the direct purchase of land from nearby villages by a private company for the expansion of its existing plant is a mere transfer of property under the Transfer of Property Act, 1882. Therefore, it is not mandatory to provide employment in the company to any family member of the seller of the land.

However, if the land is acquired under the provisions of the Land Acquisition, Rehabilitation, and Resettlement Act, 2013, Section 31 of the Act provides for employment or annuity payments to the families of both landowners and others whose livelihood is dependent on the land acquired.
