As per Maharashtra Factories Rules, 1963 ,can the Safety Officers appointment be outsourced by the Factory owner ? i.e taken on contract and not on the rolls of the company . This is in case of out sourcing of complete HSE services .
Not only safety Officer,you cannot outsource any work which is perennial in nature. Moreover, a Safety Officer is an employing coming under confidential staff. He is appointed following specific provisions in the Factories Act and notification by the government. Therefore, you cannot engage a Safety officer though a third party.
on the back ground verification company can remove to employee after 4.3 years service.
