Full and final settlement not recieved from a pharmaceutical company

Worked in a company 4.7 years, resigned 5 years back.still not recieved the settlement.
Keep on following to Hr they told one by one they are doing. Reason given company is in loss not having money.
Almost as of my knowledge more than 15 to 20 employees settlement pending.
Advocates telling filing a case it's not working out bcs settlement cases as to file immediately when resigned the job.
