24/7 Operations: Should Weekend Holidays Be Listed in Form V for Labor Office?

For companies operating 24/7 - if a national or listed festival holiday falls on a Saturday or Sunday, should we still mention it in Form V when submitting to the labor office.

As you may be aware, except for the three national holidays which are to be compulsorily adopted by all establishments (i.e., 26th Jan, 15th Aug & 2nd Oct.), all other holidays can be modeled on holiday lists published by the state governments within the territories. Any of the said three holidays falling on weekly holidays such as Saturdays and Sundays may be excluded in Form-V. However, for clarity's sake, details may be indicated in the footnote. Alternatively, such holidays may be included in the holiday list, mentioning those days also in order, which will serve specific purposes like for those having rotational weekly off, etc. For example, please see the Tamil Nadu Govt. list attached, which includes all such holidays, including those that fall on Sunday.

Purpose of Submitting Form V

The primary purpose behind the submission of Form V to the inspector, along with a copy of its simultaneous exhibition in the industrial establishment under the National and Festival Holidays Act, is to make the National and Festival holidays for the particular calendar year known in advance. The occurrence of any such holiday on a weekly holiday for the establishment or for some employees required to work in shifts is coincidental. It does not affect the statutory obligation of the employer to comply with the submission of the form.
