Workplace Accident: Does the Employee Compensation Act or ESI Cover This Situation?

Hi,

An accident happened in my company where an employee lost his fingers. My company is registered with ESIC. So, my question is, is the Employee Compensation Act applicable, or will ESI provide any benefits? The employee has filed a complaint with the police.

ESI Contribution and Employee Compensation Process

If a company has paid ESI contributions regularly, submit the concerned workmen's ESI, Temporary Identification Card, and Form 37 (information about the contribution paid). Then, in the ESIC portal, fill out Form 12 online and take a printout of Form 12. Along with Form 11 (Accident Register), submit the same to the employer's ESIC branch office.

On the employee side, he has to take the ESIC TIC and Form 37 and register with the ESIC dispensary for treatment. Compensation, if any, payable as per the loss of earning capacity and as certified by the ESI dispensary, will be paid after verification by the ESIC local office.

If the contribution has not been paid by the employer, then the treatment and compensation under the Workmen's Compensation Act have to be decided and paid by the management/company as per the applicable act.
