Can I Legally Claim My Unpaid Salary and F&F Settlement from a Former Employer?

This query is regarding the F&F settlement. I worked as a deputy manager in one company from 2002 to 2013. In July 2013, I resigned due to improper payment of salaries (we received salaries once every two months). In 2013, I joined another company. Upon resigning, my previous employer owed me two months' salary. Can I claim these two months' salary and the F&F settlement from my former employer? The company is still operational, but they continue to pay salaries once every two months to their employees. Please advise on how to proceed legally.

Hello there, if you have a relieving letter/NOC clearance and exit letters with you, yes, you can fight for F&F; as per the law, the maximum time for settlement for any organization is 45 days from the resignation date. In that case, you are eligible to fight, but my question is, why have you waited for years to clear? If the company is not ready to pay, you can go legally with proper documentation and file a case.
