Employee Absence and Benefits Inquiry

Employee was present up to 31st July 2018. Without information, he was admitted to the hospital, then left the hospital for his native place. Throughout the full month of August 2018, he received treatment, but unfortunately, he passed away on 3rd September 2018. The employer did not show his name in the ECR for the months of August 2018 and September 2018.

Questions Regarding ECR and Benefits

(1) Can the employer currently generate a new, zero-value ECR for the months of August 2018 and September 2018?
(2) Is his wife eligible to receive a pension from EPFO?
(3) Is his wife entitled to receive the EDLI amount?

I hope to receive your valuable reply on this matter.

1) Not showing the name in ECR is not a major issue. The employer can update the date of exit as 04/09/2018 with the reason "death" (no other reason, please).

2) Nomination forms completed and submitted to EPFO at the time of joining are present in the employer's file. Take a copy, and if the employee has nominated their wife as the nominee, then the wife would be able to claim by filing Form 20 (EPF) and 10D (Pension).

3) Form 5 IF should be submitted by the registered nominee.
