Gratuity Confusion: Am I Eligible with a Service Period of 5 Years and 13 Days?

I worked in the previous company for 4 years, 7 months, and 27 days, but the company issued a service period for 5 years and 13 days in the final settlement. Am I eligible for the gratuity amount?

I don't know how there could be a discrepancy between the poster's calculation of the service rendered and that of the employer's. Whether there is any mention of gratuity in the F&F statement as the employer's calculation is on the higher side so as to create entitlement for gratuity? If not, the data furnished by the employer might be due to a clerical error. It is for the poster to decide according to his conscience.

Inform the HR that they have shown incorrect information about your years of service. This misinformation will prove costly when background checks are conducted by any future employer. Apart from morality, keep this aspect in mind.

As Umakanthan sir has rightly mentioned, whose calculation is correct is better known to you. As per your calculation of service with the company, you are not entitled to Gratuity. However, as per the Company's calculation of your service, you are eligible for Gratuity.
