Waiting for Full and Final Settlement: How Long Should It Really Take?

prabhash.chaturvedi@gmail.com
Dear Sir, I am writing to inquire about the maximum time an employer has to release full and final settlement payment. I was employed at a reputable organization for almost 8 years. My joining date was 11.10.2011, and I resigned on 10.04.2019, providing one month's notice as stipulated in my joining letter.

It has been over 3 and a half months, and I am still awaiting my full and final payment. Despite numerous follow-ups, I have only received Rs. 1 Lakh as a partial payment on 6.7.2019. Since then, there has been no response to my emails, and they are not answering my phone calls to provide any updates on when my FnF payment will be processed.

There seems to be a lack of proper HR personnel, with decisions being made solely by the division director. This issue is not unique to me; they are treating all departing employees in the same manner.

I kindly request your guidance on the procedure to expedite the release of my pending payments.

With Regards, Prabhash

The full and final settlement has to be made within 10 days of the month-end or the last working day of the salary pay cycle. Gratuity has to be paid within 30 days of the last working day. Visiting the office and sorting out the matter amicably within 3 to 4 months is considered a lengthy period.

Dear Mr. Saji,

Thank you for your valuable advice. The head office of this company is in Mumbai, and I live in Delhi. So, the only communication sources available are either through mail or phone calls. I have sent many request emails to them, but I haven't received any replies. I am unable to connect with them over the phone as no one is answering my calls.

In this situation, what is the ideal step I should take? Please suggest.

With Regards,
Prabhash
