Full and final settlement - incase of less then one month and without notice

Had hired Branch manager but his performance was too low even juniors made point towards hiring and he left the company while tendering his resignation without notice period , he work in the company for the period of 22 days only, what are the HR and company to not to process full and final settlement

Hi,
It is Company specific. Considering the short period of 22 days either he can be relieved properly or can be advised to serve proper notice. However I think for 22 days notice period may not be required.

Dear Lakshminarayanan - thanks for your input . further i just wanted to brief you that person joined the organisation as Branch Manager and work for 22 days in all , even he resign as he got to know that company will terminate his employment.
will company will process the full and final or any legal liabilities.

The particular new employee has a short stint of 22 days service only in the organization that too keeping the Management skeptical about his performance which could have possibly ended up in his termination. Just smelling the rat, the employee has resigned without notice. Thus he has avoided an awkward situation of termination which could be painful to both the employer and the employee. Therefore, It is better to accept his resignation by waiving the notice period in view of the short spell of his ineffective service. He is not entitled to anything by way of F&F Settlement other than the salary for the days he worked.
