Maternity Leave Wages for Non-ESIC Employees: Who Covers the Cost?

Maternity benefits come under ESIC, and ESIC is applicable only for those who are earning below 21000/- as gross salary. Now, my question is, who will pay maternity leave wages for non-eligible ESIC employees? Can anyone suggest where this is mentioned? I am waiting for your valuable response.

Hi Madhukumar,

For non-ESIC category of employees, the employer has to pay Maternity Benefit. Accordingly, the employer has to provide Maternity leave with wages for a period of 182 days.

Because one of our employees took all maternity benefits from the employer's side. Once she completes her maternity leave, she resigns from the job and leaves the company. In this situation, what kind of action should I take?
