EPF Family Pension Dilemma: Who Receives Benefits When Nominees Differ from Legal Heirs?

Our EPF member's Date of Joining was 02/02/2018. Unfortunately, he passed away on 15/03/2019. At the time of joining, he submitted the Form-2 Nomination declaration for his father, mother, and spouse. However, only his wife and mother were mentioned in the legal heir certificate obtained by his wife.

Therefore, is this case eligible for EPF monthly pension? If eligible, who will receive the pension - the spouse or his mother?
Who will get an EPF monthly pension, the mother or spouse of the family? Any experienced person, please share your knowledge...

Hi,

For married employees, in case of death, the legally married wife and up to 2 children are eligible for a pension subject to the submission of proper documents, including the death certificate and legal heir certificate.
