Employee Lay Off rules - company don't want people who take those many leaves

naveen-gidwani
My Employer has had me lay off in accordance with the reason provided that "No Suitable work Available" after 1.5 years of employment with the company.
The reason provided is not true and my performance has been more than satisfactory. I know from an inside source that the real reason behind the lay Off were a few informed leaves taken by me in the prior month due to health issues, since the process has shifted to a new company internally and they don't want people who take those many leaves. I have been given 1 month notice however no acceptance has been taken from me. What are my options and what exactly can i expect under the circumstances. Kindly suggest as i still have another 20 days with the organization and want to make sure that i do not leave without the proper procedure followed.

Hi,
It depends on the terms and conditions of your employment contract. Irrespective of the reasons shared by you, an Employer has the right to terminate the contract by paying one month written notice either pay or allowing to work for one month.
Now you have following options
Serve the notice period properly and get relieved properly.
Talk to your Superior - decision making authority and explain the reason for leave and assure him that you will not take unnecessary leave in future. If this doesn't work follow first option.
Alternatively challenging your employer legally is another option but this will be a lengthy process - as a Company your employer may face this spending time and money but your survival during the lengthy legal process will become tough for you.
