Stuck Without My Relieving Letter: How Can I Get My Company to Follow Through?

Can anyone help me? I have been relieved from the company by serving a 1-month notice period along with compensation for my leaves and half of my salary. I asked them for a waiver of 15 days from the notice period as there is a notice period of 2 months. Now, everything is over, and I have completed my exit formalities too. They were supposed to give me the Relieving Acceptance Letter (RAL) upon the delay of the exit. They gave the reason that the CEO is not available, so they will provide it the next day. I explained that my health is not good, and I wanted to be relieved with a waiver of the notice period.

However, they did not help in any way. As I mentioned, they deducted half a month's salary, 16 days of leaves, and I served a one-month notice period. I requested every day regarding my health and provided a medical certificate as well. Now, when I call or message them, the CEO is saying, "you take care of your health; we will provide it on F&F." I have heard that this company did not give a relieving letter to one of the former employees till now, even though it has been one and a half years since she was relieved from the company. Regardless of the reasons I present, they completed my exit formalities and are now providing the RAL. I have a resignation acceptance copy via email. Now, I need the letter for my documentation. Please suggest.

Hi, in this case, you need to first check your offer/appointment letter for the respective clause on this part. In some cases, companies mention specifically that the employer is not bound to issue a relieving letter post-resignation (something similar to this). Well, considering that in your case there is no such clause:

Notice Period Waiver

First, regarding your comment about the notice period waiver, it is completely up to the employer if they want to waive off your notice period or not, even if you are ready to pay for the shortfall (again, please check your offer letter for this as well). However, in most cases, on medical grounds, employers do not deny this. But, in any case, you cannot force or claim on this part.

Claiming Your Relieving Letter

Second, if the company has accepted your resignation and you have valid documents confirming the acceptance of your resignation, and the company has confirmed that your notice period is waived off or you have served the notice period and your last working date is "__" mentioned anywhere in any of the documents and that date has passed, then you have full right to claim your relieving letter. In this case, the company "legally" cannot deny issuing a relieving letter to you.

If you wish, you may proceed legally against this company (again, only if you have valid documents confirming your last working date and you have served until that date).
