Worried About Legal Threats After Absconding: How Could This Impact My Career?

I joined XXX company in March 2018 and absconded in June 2018. Now, I have received a letter stating that I need to pay 43,000 rupees to them, or else they will take legal action against me. After absconding, I informed my manager that I was leaving. I also sent an email to my manager stating, "I have absconded from your organization and I am requesting a relieving letter."

My manager did not reply to me. Now, XXX is asking me to pay 43,000 rupees. I do not have the money to pay them. Currently, I am working in a different BPO company, having joined in January 2019. Background verification is not completed in this company, and I did not disclose anything about my previous employment.

Concerns About Background Verification

I am concerned if there are chances that my current company will find out about my previous employment details. If they discover this information, what situations will I face? Will my career be affected if I do not pay the amount, considering they have threatened legal action against me?

As rightly pointed out by Ravi, you should have followed the proper exit process with your previous employer. Regarding compensation, it is not clear about the terms of employment you entered into with your previous employer. Have you entered into any agreements? It depends on the terms and conditions of your appointment order. Please check.

If you are not going to resolve this, they will terminate and close the file. However, this will have an impact in the future with your next employer when they conduct a reference check (provided you are going to show the above employment on your resume).

Without your appointment letter, it is difficult to suggest anything good. As per the enclosed claim of Rs. 42,223/-, your employer is not providing any information regarding the notice pay, only some salary calculations based on the CTC norm.

In my opinion, you should consult a local lawyer who specializes in industrial dispute matters to advise you properly. Always strive for a smooth exit so that your future is better and more secure. If you require a relieving letter, please arrange for the necessary payment.

Thank you so much for the advice. In the offer letter, they have mentioned that if a terminated or absconded employee has to pay an amount. If I don't pay, will they file a case against me? I joined another BPO company, and I didn't mention anything about this (Genpact) company. Background verification is completed for me. Will they find out that I absconded from the previous organization and terminate me?
