Whether female employee is eligible for maternity benefits or not if she joined in Jul'18 and got pregnant in Aug'18 and due date of delivery in May' 19, she worked for approx 04 months i.e from Jul to Nov. As per law female employee is eligible if she had worked for 80 days in 12 months before the date of delivery, in her case she had not worked in 12 months. Please advise.

Employee is eligible for Maternity Leave.
Wordings of the Act do not require you to work for 12 months preceding date of expected delivery, but only means in last 12 months she should have worked 80 days.
Here she has in her period of employment itself worked more than 80 days from date of employment.

Maternity benefits are different in different regions and as per the given information, we will say that @Nathrao has said correct. Here, she has worked more than the eligible period since her joining date.
The leave period will be paid as per the daily average wage she receives.
Also, she is equally eligible for 'work from home' facility after the expiry of 26 weeks' leave period only after the mutual agreement with the employer.
