Navigating Notice Period: Can Taking Leave Extend My Resignation Timeline?

KalaiGopi
Hi all, I am working in a service-providing company in Chennai. I have decided to resign from my job, and my notice period is 60 days. In my resignation letter confirmation, I have agreed to serve the full 60-day notice period. During this notice period, I took 5 days of leave but completed all my pending work.

Questions about Notice Period

I have a few questions:

1. Can they extend my notice period?
2. If they consider those 5 days as Loss of Pay (LOP), why would I need to extend the notice period?
3. I currently do not wish to complete the full 60 days of notice. Can I serve a 50-day notice period (with a notice recovery of 10 days)? Is it acceptable to request this from HR?

Thank you.

Dear,

The reply is as follows:

1. Whether they can extend my notice period or not? As per the Act, yes.
2. If they can consider these 5 days as LOP, why do I have to extend? -- It is your choice.
3. Right now, I don't want to continue my notice period. Can I serve a 50-day notice period (with notice recovery of 10 days) or not? They can.

Hi there,

1. Yes, they can extend your notice period.
2. You can discuss whether you need to extend your notice period by 5 days or not with your HR. The notice period is to be served so that the company can hire your replacement in that time period, and also your responsibilities can be transferred to your replacement.
3. You can discuss with your HR if you want to serve the notice period for fewer days than what is required.

It depends on the terms of employment. Please check your appointment order. Some companies give the option of either a one-month notice or forfeit in lieu thereof the gross pay for one month or pro-rated for the period by which such notice falls short of one month.

In general, the purpose of the notice period is to hand over, and it is advised to avoid leaves. If availed in unavoidable circumstances, discuss with HR, and be open to the possibility of an extension of the notice period based on the workload. In general, please ensure a smooth separation from the employer, which is going to be beneficial for the individual.
