What Compliance Steps Should We Take for Construction in Gujarat with a Third-Party Contractor?

Dear Senior, I would like to know what statutory compliance needs to be followed when a separate building construction activity has been started by a third-party civil contractor with approximately 200 civil laborers in a factory situated in the state of Gujarat. (Statutory compliances from HR, Legal & Safety point of view).

Registers and Licenses Required

Kindly provide me with all types of registers to maintain, or any licenses to apply for, as I have to prepare a list of such compliance to do and accordingly inform the contractor for the preparation.

Hi Imran, please scroll through the below-mentioned points for your information:

1. The contractor must have a license under the CLRA Act with manpower strength that includes all the working laborers.

2. A notice of commencement of work needs to be submitted to the authority.

3. If five or more interstate workers are employed, contractors must have a license under the ISMW Act.

4. If ten or more building construction workers are employed, the contractor should have a registration certificate under the BOCW (RE&CS Act).

5. All amenities provided under the BOCW Act related to the health, safety, and welfare of workers should be provided.

6. If work is done on the premises of the factory, and the building being constructed is for the purpose of keeping finished goods of the factory, in this situation, the BOCW Act will be applicable. But if the building is constructed for manufacturing activity, then the BOCW Act will not be applicable.

7. PF and ESIC contributions should be submitted for all workers.

8. Various registers need to be prepared under the aforementioned Acts.

9. Expert advice must be taken to fulfill all the compliance.
