Struggling with Health and Notice Period: Can I Resign Immediately Without Penalty?

Resignation and Notice Period Concerns

As a female employee working in an NBFC company in an urban area for the last 9 years, I have been facing an increasing workload, pressure, and a hectic schedule, leading to a significant deterioration in my health.

I have decided to resign from my position and have submitted my resignation to my employer, requesting them to accept it with immediate effect. However, my employer has asked me to either work for a 2-month notice period or to pay an amount equivalent to 2 months' salary as compensation. I am deeply disappointed by my company's behavior towards its longstanding employees. I am currently unable to continue working and have proposed to work for a 1-month notice period instead.

I am reaching out to Mr. Malik, Mr. Kutty, and all other respective officials for guidance in this matter as I am unable to afford to pay two months' salary nor am I able to work for a notice period of two months.

What does your appointment order say about exit?

What is the health problem which necessitates immediate exit?

You will have to leave as per the terms and conditions of the appointment order or prove that your medical condition is so critical that you cannot work at all. Legally, you may be on a weak wicket if your appointment order has specified a 2-month notice period or buy off.
