What are the laws governing the employment of people above 58 years of age? The nature of the job is a chef, and the company is privately held. Can someone help me with the specific law? Can they be hired as regular on-rolls employees?
There is no law that bars a company from hiring people of a certain age or above. Since it is neither written nor implied, you may go ahead and hire the person. Maybe participating in certain policies or benefit programs may not be possible due to the age factor, but not hiring.
There isn't any law as such that restricts the age of candidates for hiring or mentions a specific retirement age. However, once a person achieves the age of 58, contribution to the Pension Scheme of EPFO is discontinued, and the entire contribution is made in the Provident Fund.
