Stuck in a Notice Period Dilemma: How to Handle HR Not Accepting My Resignation?

Resignation is not accepted by HR when I am serving my full one-month notice period. HR also holds my salary and pressures me to extend the notice period, while my new employer is not ready to extend the joining date. Please suggest what I should do when I am following company norms.

Normally, the employee serves the notice period only when the resignation is accepted. If your HR is behaving in a non-professional manner, try to speak to your manager and unit head before speaking to HR. Also, communicate the issue with your new employer as well.

In case HR is pressurizing you to wait some more days, get the new relieving date in writing (email or paper). Otherwise, bring this matter to the attention of the CEO.

I agree with Consultme. Your notice period counts from the date of acceptance of resignation. If your HR has not accepted your resignation, you cannot claim that they are not relieving you. Of course, no company has the right to hold an employee from opting for the employer of their choice except under legal, fair, and just agreements, if any.

Before accepting the conditions of a new employer, you should have cleared it with your present company, and only after that, agree on the date of joining the new company.

Anyways, now all you can do is request and pursue with the existing company.
