Can any body tell me is Bonus Act applicable on Software Industry....and lao guide us what is the applicability

Dear
Bonus Act is applicable to :
a) every factory; and
(b) every other establishment in which twenty or more persons are employed on any day during an accounting year.
15) "establishment in private sector" means any establishment other than an establishment in public sector;
If your Establishment comes under the above ,you are in it.

is true that first five years bonous is not applicable to new industry & later on 8.33% is mandatory
