Employee Resigned After Long Leave: How Should We Handle Her Exit and Legal Concerns?

Employee Leave and Resignation Issue

Dear All,

One of our employees has been on leave for the past 15 days. She sent us an email 15 days ago explaining that she has a skin-related issue and is unable to come to the office. Despite our continuous attempts to contact her via phone calls and WhatsApp, she has not responded. On 26th February 2019, we issued her a show cause notice, to which she promptly responded with her resignation.

Her absence has created challenges for us as she was responsible for managing our clients and did not provide any handover.

Questions for Consideration

We have the following questions:
1. What should be our next course of action?
2. Should we provide her with her documents and salary?
3. Are we legally entitled to take action against her?

You should send a registered notice to report immediately and state that she should hand over all the properties of the company and complete the formalities of exit. Until such time, her resignation is withheld. Also, mention that if she does not report within a few days, a police complaint will be registered, and all payments to her will be withheld. If nothing happens, you can initiate legal action against her.
