Hi all, I worked at a private sector company called Emfinity India IT Solutions in Coimbatore. They appointed me in the accounts section, but for three months, they didn't pay me any salary as promised in the appointment letter. Suddenly, at 11 p.m., the CEO emailed me saying they were letting me go due to financial reasons, not performance-related issues. He mentioned that the final settlement would be provided by February 15th. However, after that, when I tried to contact them via email, messages, or calls, there was no response. They didn't even answer the phone.

I have lost hope in the company. Can you please advise me on how to recover the unpaid salary amount?

Without any discussion, call, notice period, or conversation about my pending salary, they removed my job post suddenly. How can I get my salary back? Is it possible for a company to terminate my job suddenly without paying any salary?

If you have an appointment letter, then you can proceed with the labor act. Before this, kindly send them a notice through registered post, requesting them to settle your full and final dues. In your letter, provide them with a deadline to process the settlement; otherwise, you will file a complaint with the labor department.

Steps to Take for a Quick Remedy

For a quick and easy remedy, it is better to raise a formal industrial dispute under Section 2-A(1) of the Industrial Disputes Act, 1947, before the Labor Officer in Coimbatore. Mention in the complaint that you were terminated illegally without any payment for the services you rendered and ask for reinstatement with back wages and continuity of service. Upon receipt of the conciliation notice from the Officer, the management would be persuaded to settle all your dues. You can then choose a better job elsewhere.
