Earned leave can be lapsed - if any staff is not giving notice period, in that case company is not giving earned leave to staff

Dear seniors, Recently I have changed the company, and I found if any staff is not giving notice period, in that case company is not giving earned leave to staff.
For Exp: If anyone has joined on 01st May 2018 and wants to leave job on 01st Jan 19 as per data his working is 9 month as per calculation for EL his Total Present days is 238 so he Earned total 12 EL.
In this case staff is eligible for leave encasement or not, at the time of leaving company. If we talk about his notice period is One Month but he served 15 days Notice to the Company.
