Struggling with PF Withdrawal Due to Wrong DOB: Should I Take Legal Action?

Dear Sir, I am a previous employee of Future Enterprises Ltd, working from 13th November 2013 to 29th October 2016 in Gurgaon. After leaving the job, I applied for the PF final withdrawal, but it was rejected due to my date of birth being mentioned wrongly by the company. The company has a portal where employees can update attendance, leave processes, and other data. Unfortunately, I did not check that my date of birth was incorrectly mentioned, which led to my PF claim being rejected. According to the rules, it is the HR's responsibility to ensure that all employee data is updated. I have submitted all the necessary documents, including a joint declaration form, to correct this date of birth issue, but it has not been resolved yet. I also applied on the PF GMS Portal, but they advised me to contact the PF Kandivali Regional Office in Mumbai. Our HR department mentioned that this issue is out of their hands, and I should resolve it with the PF office in Mumbai.

Now, I am concerned about the way the company is handling this situation. Can you please suggest what steps I should take for my PF final withdrawal? Should I consider taking this matter to the labor court against the company? Your prompt advice on this matter would be greatly appreciated.

Form 11 and KYC Verification

They have asked you to submit a Form 11 to fill in your data and submit KYC documents. Based on this, they generate your ID in EPF or ESIC. Aadhaar was introduced in 2014, so it may not have been available at the time of joining. However, before leaving the job, you must ensure that your KYC is duly verified by the employer.

Updating Data in the Member UAN Portal

Now, you can update your basic data information (as per Aadhaar) in the Member UAN portal and request the employer to verify it digitally. If the date of birth difference is less than one year, the department will handle it. In the case of a date of birth difference of more than one year, the employee must approach the EPFO. The employer's role is limited to approving the KYC uploaded by the employee.
