Appointment on Deputation from Higher Grade Pay to Lower Grade Pay.

For appointment on deputation in an autonomous body followng all Cental Government rules, an advertisement was published for filling in GP Rs.6600. Accordingly applications were received and interview committe selected one candidate who is from State Government and drawing same GP Rs.6600.
In order to obtain his willingness to join, offer of appointment along with terms & conditions was sent in which it was mentioned that Grade Pay Rs.6600 will be given. In response, the candidate replied that now he his drawing higher GP Rs.7600 in cadre post and so he may be paid the same.
Whether his selection still exist or stand cancelled as he is currently drawing higher pay under State Government.
If exists, Whether he has to be paid higher GP Rs.7600 in place of advertised and offered pay Rs.6600 after joining.

First of all his application should not have been considered.
GP is higher and shows he is in higher post.
Question of placing an employee in lower position is debatable.

As the proposed appointment in the autonomous body is on deputation basis only, I would like to have a different view as I notice contradiction in the amount of the grade pay of the prospective candidate as mentioned in the first and second para of the thread. There is no bar in selecting a candidate on merits even if he is already in the same grade pay and the candidate's demand for hire G.P need not be considered as the advertisement has already mentioned the G.P. The management can turn down his counter offer and ask him to accept the offer if he is willing or select the next meritorious candidate.

Generally in Central Govt on deputation officers are paid one step higher pay. Nobody in Govt goes on deputation with same pay except the place of posting suits him. His appointment can be cancelled if he is not interested. There are DOPT guidelines on deputation and all departments are aware of it to take appropriate decision.

It appears that things are misconceived. After the implementation of the Seventh Pay Commission, the concept of Grade Pay is no longer in existence.

First of all while one on higher post can not be posted in a lower cadre unless untill a punishment under discipliniary action, whether may be in deputation. Your autonomous body is no way far from rules & laws of land.
Further, while one opts to work in lower salary than of its own payscale, would have no problem if one has given his consent in writing.
Do not consider one who works in upper grade for a lower grade, to avoid future complicacy for settlement of pension/gratuity etc in fututre date.

The candidate's pay in State Govt. is as per 6th P.C.
