Is It Legal for My Company to Adjust Earned Leave to Shorten My Notice Period? Seeking Advice on Next Steps

Resignation and Notice Period Adjustment

I had resigned from the company by sending a mail intimation 3 months ago. As per company policy, the notice period is 90 days. My last working day was supposed to be on the 21st of December, which was informed to me around the 20th of November. However, on the 1st of December, the company changed my last working day to the 5th of December due to their financial reasons. I had 16 earned leave days balance.

Adjustment of Earned Leave

Now, the company is saying they have adjusted my earned leave balance to reduce my notice period, and the balance cannot be encashed. My last working day was changed by the company due to their financial reasons, even though I was willing to serve the entire notice period until the 21st of December. All decisions were made in favor of the company.

Legal Inquiry and Next Steps

Please let me know if this is legal as per company law. I want my earned leave encashment. How can I proceed further?

Visit your nearest labor office (presuming that you are a workman under the Industrial Dispute Act). Otherwise, you need to file a case in the civil court for damages.
