Can I Convince My IT Company to Reduce Working Hours Without Breaking the Law?

Greetings! I have recently joined as an HR Executive in an IT firm with around 30+ employees. I have a query regarding working hours in my organization. I have gone through past threads, but my queries are as below:

Working Hours and Legal Compliance

We have working hours of 9 hours from 9:00 am to 6:00 pm (Monday to Saturday) without overtime pay, and only Sunday is a holiday. According to the Factories Act, 1948, working hours in a factory in a week should not exceed 48 hours.

Seeking Advice on Reducing Working Hours

Can these hours be reduced by conveying it to the Director, or is it completely the employer's decision? Kindly help me out with the same.

Your organization may not be covered under Factories Act. You have to follow the Shops & Establishments Act, as there is no manufacturing activity.

Working hours need to be restricted to 48 hours a week and not more than 9 hours a day.

It is essential to adhere to working hours as per the local state and establishment act. So kindly check the local enactment and fix working hours.

Dear Ms. Priya,

As per standard working hours in factories or any establishments, it is 48 hours in a week, i.e., 8 hours x 6 days = 48 hours. In your establishment, it is 9 to 6, which is inclusive of intervals and lunch. Please check, as it could be 8 hours excluding intervals for lunch, etc.
