Understanding Probation and Leave Entitlements
Probation is a process lasting for a fixed and predetermined period during which the employer makes on-the-job assessments of the suitability of a newly appointed employee to his job and the organization. Being so, the probationary status of the employee does not preclude him from claiming and availing the statutory benefits of employment like leave.
Rights of a Probationer
A probationer is just an employee whose tenure on the job is not yet formally confirmed by the employer as already fixed in the contract of employment. Therefore, the policy of the establishment, if any, cannot curtail such a statutory right of a probationer except regulating its sanction on a pro-rata basis.
