Is Gratuity applicable if a person resigns while on Maternity Leave

Dear Fraternity Members ,
One of our Female Employee had been on a maternity leave since past 8 months and now cannot continue with her employment
Is she eligible for Gratuity ? If yes - Is maternity period to be counted as continuous service ?
P.S : Period of Employment : 7.6 years considering her maternity and 6.10 years if maternity is not considered

Yes maternity leave period is counted as continuous service and is considered for gratuity calculation.

Dear Member, You can shortfall in Notice period as per the Terms of Appointment/Waive Notice period regarding Resignation.Service for gratuity will be till completion of ML
