Struggling to Get an Experience Certificate from My Employer – How Can I Resolve This?

My name is Abhishek Bhowmick. I have been working in NTPC Ltd, Assam since 2012 in the F&A department through an organization, UPL Ltd. UPL Ltd has deployed us to work in NTPC Ltd on a contract basis through a contractor.

Now, when I am asking for an Experience Certificate from UPL Ltd, which is my principal employer, they are denying to provide it. I have requested them several times, but each time they refuse to provide the Experience Certificate.

What should I do now? Kindly help me with a solution, or my 7 years will be wasted. Please look into the matter.

Hi Abhishek, are you still at NTPC or have you left? If you are still working under this contract, you need to continue urging the contractor. If you have received an appointment letter, make sure to use it. If necessary, consider writing to the UPL; if that doesn't work, escalate directly to NTPC, the Principal Employer. Seek support from colleagues at NTPC who may help influence the UPL. Avoid irritating them, but persist in your requests. If all else fails, you may need to seek assistance from the state Labour Department.

If you have left the services of the Contractor (your immediate Employer and not Principal Employer) under the Contract Labour Act/State rules, you are legally entitled to get a service certificate. You should write a strong letter asserting your right and demanding the same to be delivered to you within seven days, with a copy to the Labour Commissioner. This approach may work. If it does not, lodge a complaint with the Labor Commissioner.
