Mistaken ESI Contribution: How Can We Reclaim Maternity Benefits for Our Employee?

Dear Friends, I am working for a private company where a female staff member is covered under the ESIC scheme. We made a mistake while updating her existing ESI Insurance number with our company at the time of her joining. For example, her previous company number was 5122862015, but we mistakenly updated it as 5122862026 (the last digit was entered incorrectly). As a result, the contributions made over the last 1.2 years were paid to another unknown person who is male.

Currently, she is on maternity leave and is seeking maternity benefits. However, when we approached the ESI officials, they did not respond properly. We have all the necessary proof regarding the incorrect remittance of monthly contributions. We are in need of proper guidance on how to reclaim her maternity benefits, including the 182 days of wages.

Thank you for the reply. This may be a joke in your experience and view, but unfortunately, this is an error made by the poor new recruit who is new to the ESI portal.

There is no solution in law for such misconduct as the amount is not deposited to any fund that can be transferred. However, ask your HR team to get in touch with the Dy Director of ESI at the Regional office or SRO. He is the only person who can put a tab on the "help" button. They always coordinate in "genuine cases." It may require a couple of visits and the submission of certain documents to establish the fact.
