Stuck Without Pay and Relieving Letter: What Legal Steps Can I Take Against My Former Employer?

I was working with Aspiring Solutions in New Delhi for the past 10 months. On October 16, 2018, I received a call from HR informing me that the company was going through tough times and could no longer afford my services. Since then, I have not received any relieving letter from the company. Additionally, my salary for the month of October, for the 16 days I worked there, is still pending as part of my full and final settlement. I have spoken to the company's HR, who has been giving me excuses about some internal issues with the process manager. It has been 45 days, and there has been no update regarding my full and final settlement.

What legal action can I take against the company?

First and foremost, raise the issue by means of an email/letter to the HR asking for the settlement of your full and final payment, relieving letter, and other formalities. You cannot go for legal action without having any basis in any issue. Send a couple of reminders if required, and be very polite and diplomatic in your correspondence, but put forth all the relevant facts in your email. Give them sufficient time before you resort to any legal action.
