Facing Silence from HR: Can My Maternity Leave Be Denied or My Salary Withheld?

aastha-jain1
I work with an education institute for the past 3 years. I have applied for maternity leave as per the formalities requested over official email and have also submitted my medical documents. However, I have not received any reply from HR, and it seems their intentions are not to provide me with compensation. Nevertheless, I have completed all the necessary formalities.

Am I eligible for 6 months of paid leave? Is there any way they can withhold my monthly salary? Additionally, are there any grounds for terminating pregnant women while they are on maternity leave?

How many employees are there in the institute? If 10 or more, you are eligible for ML and salary. The Maternity Benefits Act provides statutory protection to employees who are on maternity leave. Keep your documents up to date. Intimate your pregnancy officially in writing and ask for leave in writing well in advance. If problems arise, the labor officer of the area can help you.

Hi,

Every employer that has more than 10 employees working in their establishment is required to provide maternity benefits to every woman employee. In case the HR department is not responding to your request, please approach your higher management. The last resort is to approach the labor officer of your area to resolve this issue.
