Navigating BOCW Rules: What Safety Personnel Requirements and Qualifications Are Needed in India?

Dear Sir/Madam, I have the following queries which will also be useful for other members:

Required numbers, qualifications, and experience of safety personnel

1. What are the required numbers, qualifications, and experience of safety officers, safety supervisors, and safety stewards as per BOCW Act/Rules?

Recognition of institutes for safety qualifications

2. Are the institutes (for basic and safety qualifications) required to be recognized in India or the respective State?

Contractor obligations under BOCW

3. Is a contractor legally bound to provide minimum safety manpower (numbers, qualifications, etc.) as per BOCW, and which is the enforcing agency that can interfere in case of non-compliance? If a contractual clause with the customer does not explicitly state the requirement of safety manpower as in 1 above, does the contractor still have to follow BOCW rules as a minimum?

Validity of NEBOSH and NILEM in India

4. Are NEBOSH and NILEM valid in India?

List of recognized institutes

5. Where can I find the list of recognized institutes for the purpose of basic qualification and safety qualification?

Qualifications for Safety Officers as per the Factories Act

As per the Factories Act, a candidate must have a Master's in Industrial Safety Engineering from a government-approved institution under the Ministry of Labor and Employment. Additionally, a Postgraduate Diploma in Industrial Safety from RLI in Chennai or CLI in Mumbai is required. These criteria will be taken into consideration by industries when recruiting Safety Officers.
