The Member (External) of the Internal Committee is "Nominated", NOT Appointed ( as is commonly/generally understood) by the Employer under Section-4 of the SHWW (P,P &R) Act 2013.
The IC Member (External) may be Nominated for a period of up to Three (3 ) years and shall hold Office for such period, not exceeding three years, from the date of their nomination as may be specified by the concerned Employer.
The IC Member (External) is someone
i) from amongst NGO (Non-Governmental Organisations; OR
ii) From amongst Associations committed to the Cause of Women or
iii) A Person familiar with the issues relating to sexual harassment of Women at Workplace.
While Nominating this Member (External) the Employer may/ need to take care that the Person being considered for Nomination as such possess the Virtues of Impartiality, Fearlessness, Fair, Just and Propriety in dealings with SH Complaint, the Aggrieved Woman and the Respondent and has the Clarity about the Practice of conducting Proceedings in accordance with the Principles of Natural Justice"; and
Has Thorough Knowledge and "Hands-On Skills" of Conducting Conciliation, Internal Inquiry, Cross-examination, Writing Inquiry Reports with Definite and Conclusive Findings and Other related Procedures prescribed by the Supreme Court of India and the Honble High Courts.
The IC Member (External) shall be paid such Fees or Allowances for holding/Participating in the Proceedings of the Internal Committee, by the employer, as may be Deternined by the Employer/prescribed.
The Nomination Letter be issued on the Offic Letter Head (Stationary) of the concerned Establishment and an Acknowledgement obtained for Record.
