Reinstated with Back Wages: Should Earned and Half Pay Leave Be Credited Since 2011?

If the employee has been reinstated with full back wages and all benefits, as spent on duty and paid arrears on each yearly increment since 2011.

Now, whether Earned Leave and Half Pay Leave shall also have to be credited on the 1st of every January and July since 2011?

Dear Yusuf,

Reinstatement with back wages and continuity of service implies that the orders of termination of the employee's service are non est. Therefore, all attendant benefits including E.L., etc., become eligible for the entire period of non-employment.
