How Should I Respond to a PF Notice About Alleged Contribution Evasion?

We have received a notice from the PF Department, which is mentioned below:

Compliance under the Employees' Provident Fund and Miscellaneous Provisions Act, 1952 and schemes framed thereunder

As per the information presented in the report submitted by the Area Enforcement Officer, it has come to my attention that your establishment is involved in the evasion of PF contributions as per the provisions of the act. Therefore, an inquiry under section 7-A of the Employees' Provident Fund and Miscellaneous Provisions Act, 1952 has become necessary to assess the dues.

However, before commencing the inquiry under section 7-A of the act to determine the Provident Fund dues, you are hereby provided with an opportunity to explain within fifteen days of receiving this letter why the aforementioned action should not be taken against you.

Please be aware that if no response is received, or if the response is deemed unsatisfactory, further action will be taken without any additional notice.

The charge is that "your establishment is engaged in evasion of the PF contribution as per the provisions of the act." You only have the best information/justification about the violations you have made. You may approach a Provident Fund Consultant for a reply draft, with the details given to you by the Enforcement Officer immediately after the inspection.
