Understanding Sandwich Leave: How Do Holidays Affect Employee Leave Requests?

Hello, I want your opinion on sandwich leaves.

1st Scenario: If an employee takes leave on 1st September, which is a Saturday, and 4th September, which is a Tuesday, with 3rd September being a Monday and a holiday for Janmashtami, will it be considered as sandwich leave?

2nd Scenario: If an employee takes leave on a Monday between Sunday and Dussehra holiday, which falls on a Wednesday, will the sandwich leave rule apply?

What is the type of leave applied? In case it is casual leave, most organizations do not count the holidays prefixed or suffixed. However, in the case of other types of leave, the intervening holidays are counted.

Hi,

In your first case, as per my knowledge, it's applicable under the sandwich rule. If an employee is absent continuously from September 1st to the 4th, and they are present on the 4th, then the sandwich rule does not apply.

In the second case, if an employee takes leave from Monday, the 15th, to the 17th, then only two days will be deducted from their leave balance - the 15th and the 16th - considering they will be present on the 13th and the 18th.

It depends on the policy of the company. If it is CL, some companies do count intervening holidays as leave, while in some, it doesn't. However, as per the Factory Act, in the case of EL, holidays intervening in leave are not counted as a part of leave.

Hi friends,

In my view, if the said employee availed any leave between the two days off, it will be treated as leave for all three days based on the PROF-EX-AFFIX rule.

When it is a paid holiday, then there is no need to count it as leave because these leaves are considered paid holidays, and you have to check your standing order as well. If you mark them as holidays, they will not be counted as leave.
